can anyone explain..constructive res-judicata in simple words...

See, in simple words res judicata means, when an award is declared by a court, the same will not be heard by another court of same level...it will be barred by the Doctrine of res judicata....
Concept behind this is that two courts of same level will not declare award on same issue and parties (otherwise there might be a conflict of the judgments)...
In any situation appeals to any higher court will be entertained...

Thanks Sir..Actually i have a little idea about res-judicata...
But in constructive res-judicata There r Some Words Written like defence or attack...
Dat confuses me more and more...
nd can u please tell me what are the most important chapters of GCL so that i cn start studies according to that only...as i am left with only 3 months in exam nd had not started anything seriously yey

Hi, I m gayathri magesh doing my executive programme. I am going to appear I & II modules in Dec'11. Can any body suggest what book can be read for Company Law, as i am finding very hard in institute material.

See, institute's material is designed for the real life and examination purpose so there is no way you can skip that, apart from that if you study any other book you ll still have to look in the material for references....Try to study from there and task for help if required...

For examination purpose don't miss Constitution, CPC, CCP, An Overview of Law relating to Specific Relief; Arbitration and Conciliation; Torts; Limitation and Evidence, and the TP Act and also do COMPULSORILY look upon the past examination trends and questions....
It should be fine then....

If u still need books look for "General and Commercial Laws Taxmann’s Taxmann Publication" and the relevant Bare Acts.
It think it will serve the purpose
